2019-11-23 - Treatment of Cancer Bill 2018 - New Proposed Law to affect all Irish Therapists

NEW PROPOSED LAW
TO AFFECT ALL THERAPIST
(and their clients)

THIS YOU WILL DEFINITELY WANT TO KNOW AND PAY ATTENTION TO.

A Private Members Bill is currently going through Dail Eireann called the "Treatment of Cancer (Advertisements) Bill 2018".

You may have heard of it already and feel that because it relates to Advertising, that you already follow the recommended guidelines BUT please READ ON as it is much deeper than how it first appears.

The Main Points to Note are as follows:-

1. No person shall take part in an advertisement containing an offer to TREAT or provide any remedy for cancer, or give any advice

2. To any person SUSPECTED to have cancer or TO BE AT RISK OF GETTING CANCER

3. Nurses, DR's, Pharmacists, Dentist and Social Care workers are exempt (Complementary Health Therapists, Nutritionists, Health Food Stores, Book/Books stores/Authors, Journalists, friends and family are all liable under this new law)

4. Punishment is Criminal & Civil- €1,000,000 euro fine and/ or up to 5 years in prison.
(ADVERTISEMENT INCLUDES ANY PUBLICATION MADE ORALLY, IN WRITING, AND INCLUDES
ALL MEANS OF ELECTRONIC PUBLICATION INCLUDING INTERNET, SOCIAL MEDIA
OR OTHER MEANS OF SOCIAL COMMUNICATION i.e. public meetings, workshops etc!)

 • This means that if you are trained in Oncology Massage or Oncology Reflexology, for example, you will not be able to use these therapies.

• If you would like to treat a palliative care client with Reiki you will not be allowed legally to do so.

• In fact as EVERYONE is at risk of getting cancer, you cannot legally use your therapy on ANYONE unless you are a doctor, dentist, nurse or social care worker!

• If you suggest to a friend over coffee that for health reasons they should not eat processed foods you technically are liable!

Kate O'Connell is the Minister who is funding privately this Bill.

It is a private Bill, and as such we the public, are not privy to many of the discussions.

It is worth noting that Kate O'Connell is a Pharmacist.

She is also on record as saying that once this is through she will extend it to include all chronic illness.

This Bill has already passed the first two stages, there are 3 further stages before it goes to the Senate and apparently it will be almost impossible to stop if it gets to this stage. The 3rd stage is due for Dec 4th, (just over 2 weeks time) so if this is something you feel strongly about you may want to tell people about it!

· The Title of the Bill would seem to indicate that it is to protect sick people who are vulnerable from Cancer Cures being advertised, but, surely that wording is a threat to our Freedom of Expression and our Constitutional Right to Bodily Integrity - and our right to access information outside of the realm of Medical and Pharmaceutical Industry? For example, all books that claim to have information to assist with cancer will have to be removed from stores!

· It is worth noting that we already have strict Advertising Control Laws which have been used to prosecute Cure Claims, so it is questionable as to why we need this Bill.

· The Health Care Professionals who are listed as exempt from this new Bill all do valuable work from the perspective of dealing with sick individuals. Complementary Health supports this work, and contributes its valuable work from the perspective of creating Wellness, even if this is end of life emotional support.

· It is important to note that Complementary Health Therapists are already following the Irish Government Ruling of 2005 that we should self-regulate through Voluntary Associations. Therapists are well supported in Ireland by a wide variety of Professional Associations who have strict Code of Ethics, CPD systems and professional insurance. The general public who wish to use Complementary Health Therapists are protected by these Ethics when engaging a member from these Associations.

As NRRI Member you have already signed up these.

This Bill appears to be a direct attack on Complementary Practitioners
(otherwise we would be listed in the exemptions).

If you would like the valuable contribution we make to Healthcare to still exist as an option in Ireland you will need to take individual action to highlight this Bill, before it is too late.

It seems the most effective way is to write a letter to your local TD- as a practitioner.

Your Clients should also write to their TD, expressing their concerns.

Below are two sample letters that you can copy and paste, along with some points to note if you choose to follow this line of action

 

How to Contact Your Local TD

1. You can make an appointment at your local clinic and speak with him/her directly.

2. You can email your TD using the templates provided here.

3. You can print and post your letter to TD's and Senators at Leinster House, Dublin 2.

Guidelines
To contact your TD as a practitioner, please copy, paste and edit the letter template below to include your profession. If you have other qualifications such as a Doctor, nurse, psychologist, teacher, etc. Always include this. Also feel free to stress the number of years of expertise you have.
Sign off with your own name and phone number. Don't forget to add your postal address and email contact at the top so that the TD knows that you are a member of his/her constituency.
Please feel free to edit the letter as you like. In fact, personalising it a little will probably help.
The first letter can be given to your clients and other interested members of the public to copy and paste and email and post if they wish.

Dear Sir/Madam,
I am writing to you as a member of your constituency to voice my concerns about the upcoming Treatment of Cancer (Advertisements) Bill 2018, which will return to the Committee on December 4th 2019
The wording of the bill, as it currently stands, could have serious unforeseen and unintended consequences for my access to information about health and also my access to complementary and alternative medicine.
I wish to preserve my freedom of information and choices in health care and in this regard would ask you to request an amendment to the bill to reflect this.


"Sample Letter for professional Practitioner to Email and Post to TD's"

Dear Sir/Madam,
I am contacting you as a qualified CAM practitioner and as a member of NRRI (National Register of Reflexologists (Ireland).
We understand that the Treatment of Cancer (Advertisements) Bill 2018, which will return to the Committee on December 4th 2019
The Bill as it currently stands could have serious implications for my profession and also for the broader CAM (Complementary and Alternative Medicine) sector.
We believe that we have a valid, credible and expert view in this matter, particularly as the Bill as it stands may have profound unintended and unforeseen consequences for our qualified members.
We would be more than glad to meet with you as appropriate in this matter and would welcome the opportunity to have our concerns noted and to ask you to table an amendment as soon as possible.
